These Terms of Service ("Terms") govern your engagement with Buddylytics ("we," "us," or "our"), a Florida-based digital campaign management company. By engaging our services (the "Services"), you ("Client" or "you") agree to these Terms.

1. Services Overview

Buddylytics provides managed digital campaign services, including but not limited to:

  • Campaign strategy, execution, and optimization.

  • Performance analytics and reporting.

  • Audience targeting and ad management.


2. Client Obligations

You agree to:

  • Provide accurate, lawful information required for campaign execution.

  • Secure necessary rights/permissions for any materials (e.g., creatives, trademarks) shared with us.

  • Comply with all applicable laws (e.g., GDPR, CCPA, ad platform policies).


3. Intellectual Property

  • Buddylytics Materials: We retain ownership of proprietary strategies, reports, and methodologies developed during service delivery.

  • Client Materials: You retain ownership of your brand assets, data, and campaign content. You grant us a limited license to use these materials solely to provide the Services.


4. Data & Privacy

 

  • We process data per our Privacy Policy.

  • Client warrants it has lawful rights to all data shared with Buddylytics.


5. Third-Party Platforms

Services may involve platforms like Meta Ads or Google Ads. You are responsible for:

  • Compliance with their terms.

  • Granting us necessary access permissions.


6. Termination

​

  • Either party may terminate with written notice (email sufficient).

  • Upon termination, we will return or delete Client materials as requested.


7. Disclaimers

​

  • We do not guarantee specific campaign outcomes (e.g., ROI, engagement rates).

  • Services are provided "as is" without warranties of merchantability or fitness for a particular purpose.


8. Limitation of Liability

To the fullest extent permitted by Florida law, Buddylytics is not liable for:

​

  • Indirect, incidental, or consequential damages (e.g., lost profits).

  • Claims exceeding the fees paid to us for Services rendered.


9. Governing Law & Disputes

​

  • These Terms are governed by Florida law.

  • Disputes will be resolved in state or federal courts in Brevard County, Florida.


10. Modifications

We may update these Terms. Continued engagement after changes constitutes acceptance.
